TERMS AND CONDITIONS

1 – FIELD OF APPLICATION
1.1 Premises
These general conditions of sale (“General Conditions”) govern the relationship between Oro Argento and Mirra – Gioielleria, with registered office in Corso Giuseppe Garibaldi, 277
89125 Reggio Calabria – Italy, VAT no. 02189150804 and anyone who accesses the site www.oroargentoemirra.it and addresses derived (“Site”) and place an order.
In particular, the Website is an e-commerce site that allows its users (“Customers / e”), to purchase Gold Silver and Mirra – Jewelery goods, to be delivered exclusively in Italy (“Products”).
These General Conditions are governed by the rules on electronic commerce (Legislative Decree No. 70/2003 and s.m.i.) and apply exclusively to the remote sale via the web of the Products shown on the Website.
To Customers who act on the Website as consumers, as defined in Article 3, lett. a) of the legislative decree n. 206/2005 (“Consumer Code”), ie for purposes unrelated to the business, commercial, craft or professional activity carried out (“Consumer Customers”), in addition to these General Conditions, the Consumer Code also applies and no provision contained in the General Conditions may derogate unfavorably from the Consumer Customer with respect to the protections provided for consumers in the Consumer Code.
Professional Clients pursuant to art. 3 lett. c) of the Consumer Code are invited to directly contact Oro Argento and Mirra – Gioielleria to proceed with their purchases. Nevertheless, if these professional Clients proceed to a purchase through the Site they do not apply the guarantees provided for Consumer Customers by these General Conditions and, in particular and by way of example, the articles 4.5 (right of withdrawal) will not apply. , 5.1 (legal guarantee of Consumer Clients) and 5.2 (commercial guarantee of Consumer Clients) of these General Conditions. In such cases, the rules set out in the Civil Code regarding the sales contracts and the Professional customer will be used to benefit from the Gold Silver and Mirra – Gioielleria Conventional Guarantee, and must sign and transmit the general purchase conditions to Oro Argento and Mirra – Gioielleria. reserved for professionals to be requested directly from Oro Argento and Mirra – Gioielleria.

1.2 Registration on the Site

Oro Argento and Mirra – Gioielleria remember that it is strictly forbidden to insert in the registration procedure, as well as in the procedure for creating the order referred to in article 2.2, personal data of third parties, false data, or fantasy, or otherwise deliberately incorrect . The Customer undertakes to indemnify and hold unblocked Gold Silver and Myrrh – Jewelry from any claim made by third parties or sanction in any way related to the violation by the Customer of this prohibition, reserved for every action of Gold Silver and Myrrh – Jewelery in protection of their rights.
Oro Argento and Mirra – Gioielleria is strongly committed to protecting the privacy of the customer and the security of transactions, however, it is important to highlight also the role of the customer, who is responsible for the correct and non-fraudulent use of his account and the protection of the confidentiality of their registration credentials (username and password) avoiding making them available to third parties, with the release of Oro Argento and Mirra – Gioielleria from any possible responsibility for acts or actions carried out fraudulently by the Customer and / or by third parties have had access to the Customer’s account or data due to malicious or negligent behavior on the part of the Customer.
In case of fraudulent use of the Website and / or of their personal account by the Customer, Oro Argento and Mirra – Gioielleria will have the right to cancel the account after 5 days, or a shorter period in the most serious cases, from the relative notice that will be sent by e-mail to the Customer.

1.3 Subscription of the General Conditions
The Customer is invited to carefully read the General Conditions, which are always accessible and available, in the version of time in force, in the footer of the Site. The date of entry into force of the General Conditions is indicated at the top of the document. The General Conditions applicable to the order of a Product are those in force on the date the Customer transmits the order. During the relative purchase procedure on the Site, the Customer is required to examine and accept these General Conditions, by selecting the appropriate box made available on the Site. The Customer, by completing the subscription procedure just mentioned, accepts the General Conditions and is therefore aware and in agreement that the same regulate the consequent contractual relationship, without prejudice to mandatory provisions of law. Oro Argento and Mirra – Gioielleria strongly advises the Customer to save on a durable medium, and eventually print, the General Conditions accepted during the order transmission procedure.
By adhering to the General Conditions, the Customer declares that he is at least 18 years of age and has full capacity to act.

2 – ORDERS
2.1 Product Offer
Each Product is accompanied by an information sheet describing the essential characteristics, the methods of installation and operation and the relative price (as defined below). There may be some differences between the Products delivered to the Customer and those present on the Site or in the catalog, in particular as regards the Products for which the homogeneity of the production can not be totally guaranteed or for those that have been the subject of adaptations related to the Technical or technological evolution. The Customer acknowledges and agrees that in the event that these differences do not affect the essential characteristics of the Products and do not affect their quality, they will not be entitled to terminate the purchase contract due to Gold Silver and Mirra – Jewelry (by canceling the ‘Order or refusal of delivery, or similar).

e) payment: selection and acceptance of the payment method, as indicated in the following article 3.2;
f) confirmation: summary of the Order, verification and acceptance, through the selection of a special box, of these General Conditions, together with the Gold and Mirra – Jewelery (as defined below) Commercial Warranty and the privacy notice drawn up in accordance with art. 13 of Legislative Decree no. 196/2003 (“Privacy Code”), concerning the processing of personal data of the Customer operated on the Site, and transmission of the Order.

Until the transmission of the Order, the Customer has the right to modify or cancel the Order. As indicated in the following article 3.2, when the Order is transmitted, the Customer undertakes to pay the Price and will therefore be redirected to the secure payments page managed by Ogone, in which he will insert the information required to proceed with the payment. according to the payment method selected by the Customer.

2.3 Acceptance of the Order

2.4 Availability of Products
Since the Site is visited by several Customers at the same time, it is possible that occasional unavailability of the offered Products may occur, in this case, if the Products chosen by the Client were not available, in whole or in part, Gold Silver and Myrrh – Gioielleria will communicate it promptly to the customer. In this case, the Customer has the right to choose one of the following alternative options: a) wait for the availability of the Product; b) choose another Product offered by Oro Argento and Mirra – Gioielleria; or c) cancel the Order. In the latter case, the Customer will be entitled to be reimbursed for any costs incurred, with the same payment method used for the purchase, without delay and at the latest within 14 (fourteen) days from the date of receipt of the cancellation request .

2.5 Conclusion of the Purchase Contract
The contract for the purchase of the Products between the Customer and Oro Argento and Mirra – Gioielleria will be concluded when the Customer receives the Order Confirmation sent by Oro Argento and Mirra – Gioielleria (“Purchase Contract”).
The Products ordered on the Site remain the property of Oro Argento and Mirra – Gioielleria, until the actual receipt of payment of the Price and Delivery Costs (as defined below).
However, after the withdrawal or delivery of the Order by the Customer or a person representing it, the risk of loss or damage to the Products collected or delivered is transferred to the Customer.

3 – PRICE AND PAYMENTS
3.1 Price of Products
The prices of the Products are indicated in Euros and include VAT (“Prices”). The Price shown on the Website is applied to the Products at the time the Order is sent, without any consideration of previous offers or any subsequent price changes.
The delivery costs, as indicated in the following articles of these General Conditions, are charged to the Customer and detailed in the Order (“Delivery Charges”).

3.2 Payments
Payment of the Order must be made at the time of transmission to Gold Silver and Myrrh – Jewelry of the Order, according to the methods selected by the Customer during the procedure indicated in Article 2.2 above. In particular, the Customer can choose among the following payment methods for making purchases on the Website:

Credit cards: Visa, Mastercard, Postepay and Maestro
Paypal
Wire transfer

In the case of online payment by credit card, the transaction takes place safely, using the 3D secure protocol. The confidential data of the credit card (card number, start date, expiry date, security code) are encrypted and transmitted directly to the payment manager without passing through the Gold Silver and Mirra – Jewelry stores. Oro Argento and Mirra – Gioielleria therefore never has access and does not store the credit card details used by the Customer for the payment of the Products.

In the case of payment with Paypal, the Customer will be redirected to the www.paypal.com website, so that he can make the payment of the Products, according to the procedure established and regulated by PayPal and the terms and conditions of the contract agreed directly between the Customer and PayPal. The data entered on the PayPal site will be processed directly by the same and will not be transmitted or shared with Oro Argento and Mirra – Gioielleria. Oro Argento and Mirra – Gioielleria does not collect and store in any way the data of the credit card connected to the Customer’s PayPal account or the data of any other payment instrument connected to that account. If you do not have a PayPal account, you can still choose this method of payment. When you pay, you will be redirected to a PayPal page where you will have to indicate your bank details and choose whether or not to create a PayPal account.

As part of its fight against Internet fraud, Oro Argento and Mirra – Gioielleria could be required to verify the bank details and / or the identity of the Customers before each delivery of the Products. By making an Order, the Customer undertakes to provide Gold Silver and Myrrh – Jewelry the information and documents necessary for these checks. If the Customer does not promptly provide Gold Silver and Mirra – Jewelry the information and documents requested by the latter, Oro Argento and Mirra – Gioielleria reserves the right to cancel the Order of the Customer subject to anti-fraud checks.

3.3 Billing
The invoice addressed to the Customer shows the indications provided by the latter during the registration procedure on the Site. The Customer can modify the data with each new Order transmitted on the site. Unless otherwise indicated by the Customer, Oro Argento and Mirra – Gioielleria will issue an invoice related to the Order, sending it via e-mail or mail to the person in charge of the Order.
The information provided by the Customer will be used to issue the invoice. Oro Argento and Mirra – Gioielleria therefore reminds the Customer to always check, with the utmost care, the accuracy of the information provided.

4 – DELIVERY
4.1 Delivery methods
Oro Argento and Mirra – Gioielleria will deliver only to the Italian territory, to the address indicated by the Customer during the Order creation process, according to the timing indicated in the Order (“Delivery”), by specialized carriers specially appointed by Gold Silver and Myrrh – Jewelry (“Vettori”).

Unless otherwise agreed with the Customer, the Delivery of Products takes place within 15 (fifteen) working days from the Order. The Delivery will take place without prior appointment with the Carrier and means at street level.

When the Product is taken over by the Carrier, the Customer will receive an e-mail with an indication of the expected delivery date of the Product, the tracking number and the link to follow their shipment directly on the Carrier’s website.

Delivery will be made by courier at a time between 8.00 am and 6.00 pm from Monday to Friday. The carrier will do n. 1 (one) attempt to deliver the Products to the address indicated by the Customer. In case of absence of the Customer to Delivery, the Carrier will send the Customer a communication via e-mail with the indication of the telephone number to be contacted, or the link to be selected to arrange the second Delivery. After the second unsuccessful attempt, a new e-mail will be sent to the Customer. The Products will however be kept free in storage by the same Carrier for n. 10 (ten) calendar days, starting from the date on which the Carrier sends each of the n. 2 (two) communications by e-mail above, during which the Customer may contact him for further agreements. Having spent these stocking terms in vain, Oro Argento and Mirra – Gioielleria will cancel the order. In such cases, Oro Argento and Mirra – Gioielleria will inform the Customer, by e-mail, of the cancellation of the Order and the terms and conditions for reimbursement of the Price of the Products, excluding the Delivery Charges, which will be charged to the Customer.

If the Customer wants to check the status of his Order, he can consult the online page of the Carrier’s website or he can contact us in the manner indicated in the Contact Us section of the Website.

In the presence of extraordinary needs of the customer (including, but not limited to, ZTL, need for porterage or special permits, smaller islands, areas difficult to access, particularly adverse weather conditions), the date and time slot chosen the Customer may undergo variations, which will be promptly communicated by Oro Argento and Mirra – Gioielleria to the Customer. In case of absence of the Client on the day and in the chosen time slot, Oro Argento and Mirra – Gioielleria will charge the Customer for the next delivery attempt.

4.2 Additional services
The Customer acknowledges and agrees that, upon specific request of the Customer, in the event that:

– Delivery is required in areas where traffic is subject to limitations and / or prohibitions, such as, for example, restricted traffic areas, areas with limited entrance to vehicles, pedestrian areas, etc .;
– the distance between the point of unloading and the property of destination of the Products purchased is more than 100 (one hundred) meters;
– the property of destination of the purchased Products does not have a lift, a hoist, or in any case a staircase and / or doors having dimensions and capacity suitable for the passage and lifting of the Products;

Oro Argento and Mirra – Gioielleria will charge the Customer additional costs necessary for the above mentioned additional services. In order to have all the necessary information related to the costs of these additional services, the Customer is obliged to contact Oro Argento and Mirra – Gioielleria, before sending the Order, according to the methods indicated in the Contact Us section of the Website. of the Order, the Customer will be obliged to contact Oro Argento and Mirra – Gioielleria, always through the aforementioned contact channels, to promptly inform Oro Argento and Mirra – Gioielleria of the necessity of the aforementioned additional services and to proceed with the relative payment to be made by Card of credit.

4.3 Delivery costs
Delivery costs are charged to the Customer and detailed in the Order and in the Order Confirmation. For each of the Orders, the processing and shipping costs are calculated according to the place of delivery and the weight of the package: once the postcode has been inserted in the order creation procedure, the actual amount of the Delivery.

4.4 Reception
The Customer agrees to be present at the time of delivery or to appoint a person of his trust to receive the Delivery, within the period specified in the Order and in the Order Confirmation. Therefore, the Customer undertakes to refrain from intervening or from having a third party intervene for this purpose. The claims accepted by Oro Argento and Mirra – Gioielleria will give rise to the replacement of the defective / non-compliant Product / s, or to its reimbursement in case of unavailability of the Product / s in stock or at suppliers, according to the terms and conditions of guarantee set out in Article 5.

4.5 Right of Withdrawal
Pursuant to art. 52 and ss. of the Consumer Code, the Consumer Customer, as defined in the previous Article 1.1, has the right to withdraw from the Purchase Contract for any reason, without explanation and without any penalty, with the methods specified below (“Right of Withdrawal”).
The Right of Withdrawal may have as object all (total withdrawal) or only part (partial withdrawal) of the Products purchased by the Consumer Customer and may be exercised within the term of 14 (fourteen) days from the day on which the Consumer Customer or a third party from he appointed, other than the Carrier, acquires the physical possession of the Products / o (“Withdrawal Period”).
The Right of Withdrawal is exercised by sending – before the expiry of the Withdrawal Period – a notice of withdrawal using the return form or by any other explicit declaration of the intention to withdraw from the Purchase Contract (“Notice of Withdrawal” ) by mail and / or e-mail to the following addresses:

In case of exercising the Right of Withdrawal, the Consumer Customer undertakes to return the Product (s) to Gold Silver and Mirra – Jewelery within 14 (fourteen) days from the date on which the same has communicated its decision to withdraw. This deadline will be respected if the Consumer Customer provides for the relative shipment of the Product / s subject to the Right of Withdrawal before the expiry of the 14 (fourteen) days (“Return”).
Gold Silver and Myrrh – Jewelry reminds Consumers that the transport costs related to the Return of the Product / s subject to the Right of Withdrawal are charged to the Consumer Customer and that the Return is under the full responsibility of the Consumer Customer. Oro Argento and Mirra – Gioielleria also reminds Consumers Customers who, before returning, must check that the Product / s object of the Right of Withdrawal is / are intact / and in normal condition, included in the original packaging, complete in all its parts (including packaging and accessory documentation).
If the Right of Withdrawal has been correctly exercised according to the provisions of this article 4.5 and by the articles 52 and ss. of the Consumer Code, Gold Silver and Myrrh – Gioielleria will reimburse to the Consumer Customer the full amount already paid, excluding the Delivery Costs, within 14 (fourteen) working days from the day on which it was informed of the Consumer’s decision to withdraw from the Purchase Contract.
The amount will be reimbursed by the same means of payment used by the Consumer for the initial transaction, unless expressly requested in writing by the Consumer, provided that the Consumer does not incur any cost as a consequence of the reimbursement and that the chosen mode falls within those indicated which methods of payment to the previous one, always limited to the payment methods provided for in Article 3.2 of the General Conditions.
Oro Argento and Mirra – Gioielleria, according to and for the purposes of art. 56 of the Consumer Code, reserves the right to withhold the reimbursement due to the Consumer Customer, until he has received the Product / s subject to the Right of Withdrawal or until the Consumer Customer has demonstrated that he / she has returned the / Product (s), whichever situation occurs first.

5 – WARRANTY
5.1 Legal guarantee for the Consumer Customer
The Consumer Customer has the right to use the legal guarantee provided by the Consumer Code in articles 128 and following. The legal guarantee is provided directly by Oro Argento and Mirra – Gioielleria, according to the law, and nothing provided for in this article 5.1 of the General Conditions may derogate from the provisions of the Consumer Code, which the Consumer Customer is invited to consult in the version of time in force.

5.1.1 Contents and duration of the guarantee
The legal guarantee applies to all Products purchased by the Consumer Customer, regardless of the Commercial Guarantee (as defined below), that Oro Argento and Mirra – Gioielleria only offers for certain Products in the terms indicated in article 5.3 of the General Conditions.

Gold Silver and Myrrh – Jewelry is required to provide a product suitable for the usual use of a good of the same type and in accordance with the technical and commercial description of the Product supplied by Oro Argento and Mirra – Gioielleria on the Site. This conformity also presupposes that the Product has the qualities that the Customer may reasonably expect, taking into account the characteristics and presentations of a good of the same type and / or of any declaration made by Oro Argento and Mirra – Gioielleria.

Oro Argento and Mirra – Gioielleria is liable to the Consumer Customer for any defects in conformity of the Product existing at the time of delivery.

The Legal Warranty is valid for a period of two (2) years from the Delivery of the Product, when the conformity defect is manifested within this period, on condition that the Consumer Customer denounces the possible defect within two (2) months from the relative discovery . After reporting the defect, Oro Argento and Mirra – Gioielleria reserves the right to offer you suitable remedies.

The Consumer Customer may in any case request the restoration of the Product, within a reasonable period and without expenses, by repairing or replacing it, unless the remedy requested is objectively impossible or excessively burdensome with respect to the other, taking into account the value of the Product and of the extent of the defect found.

The Consumer Customer may also request, at his choice, an appropriate reduction of the purchase price of the Product or the termination of the Purchase Contract, where the repair or replacement is excessively burdensome or where such operations have not been carried out in a reasonable time. and / or have caused considerable inconvenience to the Consumer Customer. In such cases, Oro Argento and Mirra – Gioielleria undertakes to reimburse part of the price in the event that the Consumer Customer requests a reduction in the Price, or the entire Price in case of request for termination of the Purchase Contract, within 14 ( fourteen) days, respectively, from the request for partial reimbursement of the Price (without return of the Product by the Consumer Customer) or from the receipt of the returned Product. A minor lack of conformity for which it was not possible, or it is excessively expensive to carry out the remedies of repair or replacement, does not entitle the Customer Consumer to terminate the relevant Purchase Contract.

5.1.2 Functioning of the guarantee

Shipping and / or return to Gold Silver and Mirra – Jewelry of the Product are charged to the Consumer Customer who will be required to send it within 30 (thirty) days from the notification of the defect found at:

Oro Argento and Mirra – Gioielleria will check, within a reasonable time, the methods and timings within which the product will be repaired and / or replaced. A Product repaired or replaced in application of the Commercial Guarantee remains guaranteed under the same Commercial Warranty conditions that were originally granted at the time of purchase of the Product and until its expiration.

The Customer Consumers acknowledges that any Product returned to Gold Silver and Mirra – Jewelry becomes the property of Gold Silver and Mirra – Jewelry at the time of a possible replacement.

5.2 Commercial Warranty Consumer Customers
In addition to the legal guarantee provided for in Article 5.1 above, Oro Argento and Mirra – Gioielleria offers Consumer Customers guarantees of up to 5 years depending on the type of Product as indicated from time to time in relation to the same, in the technical sheet of each . 5.4 Exclusions of Guarantees
The Products not covered by the legal guarantee and / or the commercial warranty, returned by the Customer to the Silver Customer Service and Mirra – Jewelry, without the prior agreement with Oro Argento and Mirra – Gioielleria, may be legitimately refused by Oro Argento and Mirra – Gioielleria or be subject to management or storage fees, which will be charged to you.
In the event of a claim, if the Product is not covered by the legal guarantee and / or commercial warranty, the Customer will be promptly notified via email to the known address at Oro Argento e Mirra – Gioielleria and, where available the after-sales service, will receive a communication concerning the possibility of repairing the Product, or replace it with a new Product or with a Product with similar characteristics, indicating the relative cost to be incurred.

6 – COMPLAINTS AND COMMUNICATIONS
6.1 Procedure for customer complaints
Any complaint must be presented to the customer service offered by Oro Argento and Mirra – Gioielleria, from Monday to Friday from 8:30 to 19:30 (“Gold Silver and Mirra – Jewelery Customer Service”), using the contact channels listed in the Contact us section of the Site and will be taken over by Oro Argento and Mirra – Gioielleria within 15 working days from the sending of the communication by the Customer.

6.2 Communications
Any further communication, without prejudice to the provisions of the preceding art. 4.5 “Right of Withdrawal”, may be addressed to Gold Silver and Mirra – Jewelery Customer Service using the contact channels listed in the Contact Us section of the Website.

7 – USING THE INTERNET SITE

7.1 Intellectual Property
Oro Argento and Mirra – Gioielleria is full and exclusive owner, that is, has the right to use, the elements published on the Site, including, in particular, the logo, trademarks, texts, photographs, images, drawings, models or tables. 8 – FORCE MAJEURE

8.1 Cases of force majeure
Oro Argento and Mirra – Gioielleria will make every reasonable effort to fulfill its obligations in relation to the Order. However, and notwithstanding any other provision of these General Terms, if Gold Silver and Myrrh – Jewelry were unable to fulfill contractual obligations due to fires, wars, strikes, embargos, government regulations or other civil or military authorities, omissions and negligence of carriers or suppliers, vandals or hackers, breakdowns or malfunctioning of third party networks, telecommunications equipment, websites, software and hardware or other technologies, or other events beyond the reasonable control of Oro Argento and Mirra – Gioielleria ( “Force Majeure”), the period for the performance of the services in question will be extended for the period of delay or impossibility to fulfill due to the specific causes of Force Majeure. It is understood that the continuation of a Force Majeure situation for more than sixty (60) days will allow the Customer to withdraw from the contract for the sale of the Products or supply of the Service, provided that no compensation or indemnity will be due by Oro Argento and Mirra – Jewelry.

9 – Competent court
In the event of a dispute arising from the interpretation and / or application and / or execution of the General Conditions and Purchase Agreements concluded under the same General Conditions, it will be competent to decide on the merits the Court of the place of residence or residence of the Consumer Customer, if located in the territory of the European Union or, at the Customer’s choice and in case of action taken by the Consumer Customer, the Court of Reggio Calabria.
